We are just about to put a deposit on a villa in Sector C (C5) but we are concerned about the condition of the road (Calla Retama). It looks like it has subsidence as there large ruts and cracks and generally in a very poor state of repair. The villa we want to purchase is very close to this. Could anyone living near to this road please advice.

If in doubt. Would you buy a house in UK if you had these doubts about an area regardless of price.

Agree... Steer clear if there are obvious signs of problems. Plenty more properties. Good luck!

There are some interesting videos on Youtube search " Camposol" including one hosted by a  uktv program.

Your worries and doubts will probably be answered.

It would also be wise to read this link,

It gives an insite to the build quality and the legality of the builds.

 It tells you all about the builders and the inherent problem with the location and what can and cant be done long term to help all those unfortunate owners. 

It tells you what the investigation by the British Consulate uncovered and what the current position is with the Spanish Govermnent.

I walked away from a fabulous detached villa at an " unbelievable" price after doing research and unfortunately lost my deposit as a result . (currently in legal proceedings)

I had a lucky escape. 

Property on Camposol is " unbelievably" cheap for a reason!

Most don’t have habitation certificates!!

Please don't get too caught up in the negative stories you may hear or read regarding Camposol.

There are some issues with subsidence but  only on a couple of streets (as far as I know upper c) and a few areas on D which are prone to flooding but given how big Camposol is the majority do not have subsidence issues!. I bought on C1 last year and have no regrets, that being said I paid for a structural survey (as I would do buying any property) This did highlight some building issues however it was down to the seller to agree to the costs of the work to be done. In my case 10,000 euros was held back by the solicitors for the work . Surveyor also employed someone to test the soil - No subsidence!  So please do get a survey which could potentially save you money and importantly give you peace of mind , also ensure you have a decent solicitor. Please also remember only sector A has been adopted by the council so you will find a lot of roads not in a good condition (but probably no worse than the roads in the uk!)

Hi Golly G,

We bought a holiday home on Lower C last year and I have seen the subsidence on the road you mention, it’s so bad in areas that you are wary of driving there. However I am no surveyor but the houses in this area seem ok, if you look on upper C, you will see houses and roads in a very poor state and some of these properties must be impossible to sell, however some are buying them, personally I didn’t.

It is a good idea to get a survey if it’s near subsidence but whatever some say about Camposol, we have a lovely little villa that seems absolutely fine and at an affordable price and to top this we’ve just had two weeks there and properties were selling near us whilst we were there.

It is a well known fact that the majority of houses on B,C,D do not have habitation certificates due to the issues between the builders and council. So your request for a showing of a habitation certification is unlikely to happen (as I imagine you well know)

That being said houses are bought and sold through out Spain every day without one. Equally and if not more importantly is to ensure that the building is structurally sound (survey) that any debts are settled, the utilities are in place and put in your name and that the property has deeds. Any decent solicitor will ensure all that happens..At the end of the day many notary's will and do sign off houses every day without a habitation certificate!

A Notary does not guarantee the legality of your purchase, whether it has a Habitation Licence or not.

There is no comeback on a Notary if later you find out you have been duped, lied too or your property is not legal to live in (no Habitaton Licence)

They are there to ensure both parties understand the documents, that the Land Registry are informed and the appropriate payments are exchanged, taxes paid and especially their fee is paid.

Search google about Spanish Notaries to find out all about them. 

They are no help to a Buyers mistake. That is not their role. They do not protect you.

Only your Solicitor can be made responsible " if you ask the questions" 

Questions often overlooked by novice purchasers are:

Is there an outstanding mortgage to be cleared by the vendor?

Are there any attached debts?

Is there a Habitation Licence  so you can legally live in the property?

Can he the Solicitor ensure services are connected and change of ownership be transferred?

The UKGov website covers every pitfall you need to be aware of when contemplating buying Spanish Property.

There are many families who have had their homes bulldozed flat for not being legal In otherwords never given a Habitation Licence.

There are many areas throughout Spain at risk of one day Central Government giving the demolition order. 

The risk is always there it will never go away.

There are many reasons why property does not have the legal documentation and will never get it. 

If the Townhall did not give the First Occupation Habitation Licence when they were first built its almost guaranteed in the Spanish system " you will not get one".

There are many websites confirming this information. Local and national newspapers have covered the legal fight for these residents including the case conducted by the English Consulate.

Do your research before you are tempted to pay a deposit for that bargain property.

It's a " bargain" for a very good reason.

Always the first rule of buying, the first question is - is there a First Occupation/ Habitation Licence.

See the agent or their recommended legal bod woffle at this first question when they very well know the property they are  trying to sell you is not legal.

Advice - walk away!

You have probably worked hard all your life to buy your dream Spanish property, do not be duped by sales-talk to throw your money away on a non legal build.7

Good luck to all those about to buy property trust this post will give you some guidance as to how to do it right.
