Mu husband was unable to come to Spain when we initially purchased our property, which meant everything was done in my name. Now we are here and are on our visa's we wanted to change the deeds to joint names. I have just been quoted €4500 this seems very high. Has anyone else done this or any advice please.

Unfortunately your husband actually has to purchase the other half when I wanted to put a property into a sole name for personal reasons I had to purchase her half pay all taxes and fees it unfortunately Is the situation and I don't believe there is anyway around, I do suggest you go straight to a notary for this transaction as a solicitor or gestoria will have to do this to change the deeds.

I was advised by legal people that if my husband was on the deeds then he would have to pay taxes in Spain as well as me and to leave the property to him in my will. I would shop around for quotes as the charges are sometimes different unless it is based on a percentage of the property price.

The price is to do with the catastral value of the property, when a property is left to a partner or spouse heavy taxes can occur through unearned income

There is a way to give your husband half the property but it will take a few years. You can do a "donation" of 50% of the property that is currently in your name, if you can prove that your husband has lived with you in the property for 7 years and can show continuous "empadronamiento" in the property for that entire period. You can do this through a solicitor or directly with the Notary. We did this on our last house as it was originally bought in my name only, although my husband was funding 50% of the costs. He paid a very small percentage of transfer tax but saved the huge amount of tax that he would have had to pay, had the division been done as it it were me selling him half the house. Once the property is in both names as equal partners, you will both then be liable for any taxes that are incurred on the property, rather than just you paying them all. You would also need to update any Wills that you have made here in Spain to reflect the change of ownership.

That's very helpful to know. It could save someone a lot of money. I have the opposite problem - wondering how much to take a name off the property deeds due to death. Is it really necessary?
