Saw my Gestor again yesterday. They have email’d DGT a few times to ask what’s going on. Had no reply yet.

Apparently the 'new' ruling, effective today, is that if approval of Resedencia/TIE application (Item 3 above) is after 31 December 2020, you can no longer exchange your UK licence! 

News to ALL in attendance today.

I am now officially a Spanish Resident, but will no longer be able to drive after 30th June, 2021 unless I pass the Spanish driving test!

Will investigate further and update if/when I have any answers.


Our circumstances are exactly the same.  Residency apps went in on 4th Sept.  We applied for driving licences in early Dec 2020. TIEs finally arrived in early January.    We received the following from our Gestors stating, as was written, because we cannot show legal 'residency' prior to 2021 we cannot have driving licences.  Note:  The UK has not made any agreement with Spain with regards to permitting the 'exchange' of driving licences from UK to Spanish pre 2021 residency.  Looks like we shall all have to take the driving test.  We shall be prepping accordingly.  Hope this helps others.

"Community renewals whose first residence is dated 2021 cannot be admitted because from 1/1/2021 they are no longer community. Unless they provide a certificate of first residence from the national police where they recognize their residence from 2020."

This file was verified by telephone on December 17, 2020. He has the residence application dated August 20, 2020, but the favorable resolution is from 2021 (logically for reasons beyond the control of the interested party ...). How can you proceed to redeem these permits?

You cannot because the resolution is from 2021. You will have to wait for the agreement between Spain and the United Kingdom to be made.


In summary, it seems that changes of driver's license cannot be processed until the agreement between Spain and the United Kingdom on this matter is made.What we can do is collect your original licenses from the Traffic Office and when there is an agreement between the countries, process them. At the moment we cannot do anything else.

My Gestor went to Traffico today and got exactly the same response unfortunately.

Followed the rules but they have now changed the goalposts!

Hope you'll get back when you get a reply.

We all keep hoping to hear at some point someone will come up with a more favourable reply that will resolve this issue.  Just maybe .....    Perhaps we should all be lobbying the UK Foreign Secretary!

My Gestor specialises in TRaffico problems. They have a lot of customers now in this position. I saw them on Friday for an update. They have one person now going through the process of getting EX15 approved by traffico. This is proof that they applied for residency in 2020 and it was accepted in 2021. This person now needs to attend aTraffico appointment to start the licence exchange. 
gestor is putting this one customer through this new process as a trial so if it works then we can all go ahead. So a bit of optimism now
