HI All

Any advice will be greatly appreciated.  

We are currently renting in Camposol with a view to buying as we really like it here.  However, we have been told that the only sector A  homes have a habitacion certificate.  I know this is a legal requirement but we are being told that there is no problem buying on other sectors without one as its been ongoing since they were built and people can have utilities etc., in their own names and can sell if necessary.  My concern is that without this certificate the authorities can at any point say that the property must be demolished.  Am I right to be concerned or am I just being over cautious.

You would be right to worry if you did not get your deeds for the property but habitation cert's or as we call them in England completion cert's are to say that the building is built to spec and fit for habitation, in the future you might have to get a habitation cert at a cost but whoever said that your property could be knocked down without one is talking crap. As said at the start just make sure the property has the deeds, all the best..

Obviously it's your money, your decision. There are thousands of houses for sale in Spain with the correct paperwork in place, I cannot understand why anyone purchases a property knowing that it doesn't have ALL the necessary paperwork.

rma44 is right, there are thousands of houses all over Spain for sale, but if your looking for value for money, great community spirit, all amenities at your disposal, then your looking in the right place and don't worry as longs as you have the deeds / Escritura in place ain't nobody knocking your property down, all the best with your search

Who has told you this? Your solicitor? Have you actually had your solicitor look into all the legal documents of a particular property? I did before I bought mine. And yes there are properties for sale all over Spain as rma44 states & many of them have the same issues with not having the correct paperwork etc - not just Camposol.

Absolutely agree. Many are illegal builds; owners that can't be traced, missing paperwork etc etc! The moral is.....look at the property objectively; ensure all the paperwork is place and make sure the debts are settled. I know the agent will tell you all is OK, and the solicitor will say don't worry, but it's your money not theirs. If you think something is wrong or too cheap, walk away!

The house you are looking at should have a Fin de Obra, (finish of works), an energy certificate and a land registry  certificate, as well as the deeds.  95% of the houses  on camposol have not got a Certificate of occupation as the builder went bust and the council is stuck as the place isn't finished and they say they can't afford to finish it.. Much discussion has taken place over the years, with everyone pointing fingers at everyone else.

As a result you can buy a nice detached bungalow, with a swimming pool for about E97,000, as a lot of Dutch people seem to be doing around me at the moment and I was struck  by the number of sold signs last time I was out in October.  Basically nearly all the houses that the builders were hanging onto were auctioned off, bargains were had, sorted out, painted  and rapidly sold.  As a result the place is looking a  lot better  and most houses are being sold  quite quickly.

  As for the council they did look at demolishing 500 houses at one stage, did the sums, 500 x 100,000 = 500,000,000 or half a billion euros + compensation.  Lawyers appeared out of the woodwork.  Council  had a fit and decided to sort out the storm drainage about  instead, 4 years ago.  Plans have been displayed and meetings have been held.  Elections are coming and promises have been made.  A street sweeper has been seen.  Don't watch this space.
