Mrs applied for a Irish passport on the back of Mr, answer from the Irish passport office ( NO ) you must live in Ireland for a minimum of 2 years to apply for a Irish passport.

So this scuppered their plans, as the 90 day applies to Mrs, and she is logged in at the Spanish airport, and logged out to see she does not breach the 90 days, or heavy fines are applied.

In addition, the EU passport for non Spanish residents I believe has a limit on time also, or you become liable for tax, and will be asked to complete the 720 declaration, ( please check this with your solicitor, I can only go by my neighbours who are stuck over this )

You need it checked legally, and in writing.

My wife is Irish and I am British.

We are moving over next month on Freedom of movement on her Irish Passport.

She will be going for residency and I will piggy back on this.

We have had no problem so far with this so 90 days does not apply if you are married.

That’s correct in what you are saying.

Once you have registered before 90 days the spouse can piggy back this is exactly what my wife and I intend to do when she receives her Irish passport

strange, never heard of that rule, but everyone seems to say something different.

Worth checking it out, as we did when my wife got her Maltese passport and I applied for mine,  our solicitor gave us a different version of the rules re staying and tax, and they were right when we had to declare every thing we had under the 720.

Nice one, I will tell them, as Mrs can only do 90 days, and cannot get a passport without Irish residence for 2 years, and if Mr breaches his time, he becomes tax liable for everything.
