Buying in Camposol

What are main questions that your Solicitor should be answering when buying a property on Camposol.

We have put a deposit on a property in D Sector and just want to be sure our Solicitor answers all the vital questions on our behalf.

Any advice appreciated 🙂

Hi there,

Just a couple of things you should ask.

Is this property built on the Rambla de Los Aznares? (The Rambla runs across the entire length of the streets just above the length of Calle Nogales/ Calle Piteras on D sector. Banks have refused mortgages on some of the 450 houses built on the Rambla. This may not affect you when buying but sellers have lost their sale as their purchasers needed a mortgage. There are plans to reroute the Rambla but nothing confirmed yet).

Is the property registered as Touristico? (Many properties were listed as touristico meaning they can only be rented not lived in permanently. Most of these have been resolved).

Is the property on a public or private road? (The council said about 3 years ago that they will not and cannot legally carry out works on private roads. The two main issues are lighting and road surfacing. So if it is a private road, your lights will not be maintained. If turned off, the council will not turn them on. Several streets have got together and bought their own solar lights.)

Your lawyer should ensure that all permissions for work carried out are registered, they normally arrange for your utilities, electricity and water to be continued and will, if you ask set up direct debits for these and your annual IBI (council tax), which will be taken from your account around 6th October each year. The lawyer usually keeps a retention from the vendor to deal with any issues, such as unpaid utility bills. Discuss this with them.

You may also like to ask them if the property has a fin de obra or a habitation certificate. It is unlikely as it is on D sector  worth discussing with the lawyer what the effect of this is, for future reference.

Finally, and I am sure others will give you more questions based on their personal experience, have you had or considered a survey in the property? Should be about €400.

Finally, finally, many people recommend using a lawyer that is not recommended by the estate agent.

I would second all that Nigel has advised, also ask if the Solicitor is also going to arrange your non residence tax (if you are buying for holiday home) this is often missed in the advice section, as Nigel also states always best to use a solicitor that is not paying a commission to your Estate agent 

I am assuming as it would be a given that your solicitor is arranging your NIE also 

also ensure that you get an estimate of costs before you start the process and use this as a guide as a number of costs are estimated and all good solicitors will over estimate the cost and when the buying process is finished you may just get a nice windfall once your portion of IBI is paid for the current year, we received just shy of €800 back we completed in April and got our refund in November just after the IBI is due

No not at all, if you are going to be a non resident it is good to have the POA in place just in case

Agree with all.

Just check no building work has been carried out on the property since 2015 May, as it is illegal, there is no permission to build extensions, under build living etc.

 No small builders permits have been issued from that date, and it will not be on the deeds, any thing that is not right, and you sign for, you will be liable, and the council will hold you responsible, along with any fines to be paid.

All documents you are asked to sign are  always in Spanish, if you do not understand Spanish, do not sign unless a interpreter is with you, or they are translated.

Yes, check if it is a private road, if it is you are not covered by the council for any thing.

Welcome to Camposol, it is a great place, its just you do not want any surprises later, so check now.

Hi 

We are looking to buy a property in Spain to come to as a holiday home and eventually live there. Can I ask, what is Camposol like for children? We have been shown a property there and it looks perfect and within our price range. Is there activities for kids? Thanks any advice appreciated.

Hi there, you may be better to post this as a separate question, as the subject of this thread is very different from the one you are asking. There are more young people with children now, so they would be best to answer the question for you
