Good afternoon,

I would like to ask a few questions and hope someone may be able to offer some advice.

My husband and I have just sold our house in the uk and we are intending to move to Camposol early next year hopefully Jan / Feb. We have decided to rent first for about 6 months just to get the feel of the place etc and then if we like it would buy something after that.

Do i need an NEI number to rent?

Are there any short term lets for about 6 months or are they long term ?

Is it correct we can stay for 90 days before we need the relevant documents and private insurance?

We are really excited but its a huge move for us and we want to get it right. I am retired age 66 and my husband is 63 so not retired just yet.

Any comments are more than welcome

Hi

       I would wait a few weeks until the dreaded Brexit deal or no deal is sorted by our Government at the moment any sort of travel plans are difficult to plan with Brexit & Covid, but good luck I'm sure you'll love Camposol and a wise choice to rent first because you can look around and decide which Sector suits your needs before buying a Villa.

Assuming you are UK Citizens without Irish passports ...

Do I need an NIE number to rent?   - Probably not as your rental will be short, but you should ask this question of your proposed rental agent. Initially, you will just be on holiday

Are there any short term lets for about 6 months or are they long term ? - You cannot come for 6 months. You are constrained to 90 days in any rolling 180 .... so after 3 months, you must go home (unless/until you gain Residency - your TIE).

Is it correct we can stay for 90 days before we need the relevant documents and private insurance? - No. Your EHIC will invalid after 31/12/20. You need travel insurance. 

To gain Residency (TIE) you need to buy a home or have a long-term lease (either of which definitely needs a NIE).

So ... come for (up to) 3 months, find a home to buy or lease (long term), then your Spanish Solicitor will start the ball rolling on NIE, bank account, Residency etc. You will need to return home after 3 months, and this can carry on in your absence.

"Residency" confers the right to stay indefinitely (there are some caveats around that statement, but your solicitor will give you the necessary advice).

Before you spend any money/make any plans you must be aware that to gain Residency, you need to demonstrate that you will not be a burden to Spain, and that (a) healthcare and (b) income are tested. 

(a) neither of you will qualify for free healthcare. You will need to pay for private healthcare (assuming no serious pre-existing conditions, initially around 2500 Euros per year for the two of you)

(b) after 31/12/20, the UK is like any other 3rd nation, and the financial hurdles for Residency are set to increase significantly. The absolute figures do not seem to have been published, but people are speculating that an income of 32K Euros/year is needed for a couple, or a significant bank balance.

Spanish Residency means that you will be liable for income tax in Spain. This is generally higher than in the UK. Get professional advice on this before committing.

I think so, mine is due for dispatch on 7/1/21

With it comes Treaty right for my wife who cannot get an Irish passport.

Irish Passport allows freedom of movement, not breach of EU laws

As I understand it

I will be able to travel freely in EU, if I (or am likely) to spend  more than 90 days, I should get non fiscal Resident, if I spend 183 days in a calendar year then I should be tax resident, fiscal Resident.

The first may apply as we hope to buy next year but the second will not.

Ireland is not a 3rd party country so you are also allows to travel if you want to during the different states of Emergency when UK passport holder may not be allows subject to the rules of the countries at the time.

Yes, Will60 you are totally correct. The only thing I can add that anyone obtaining their TIE is, it will have temporary permission  on it. Not Permanent.  This could give problems in the future, depending on the terms of the agreement  ( or not). At the moment things are not looking good for people wishing to come to Spain, or anywhere else for that matter. It is going to require a significant amount of money coming in every month. At least €2k . I do hope fairy cakes has got one hell of a pension.
