Trying to totally understand this capital gains tax in Spain.

We have just sold our house in uk and bought in Spain this should complete between August 22 and September 22.

My wife is Irish and we are going for residence.

Spanish tax year January-December.

We have only had 4 days in Spain this year.

Will this work as not to pay Capital gains tax as we are not resident

Provided that you do not gain Residency before end June, you will not be tax-Resident in Spain until next year. So no Spanish CGT on house profit realised this year.

Hi there. We have recently sold ours and doing the same thing, with an aim to get there August too. In spain we will have to submit a tax return next year, They will look back to see if we were a tax resident by checking between Jan and December of 2022 if we spent more than a 183 days of this year in spain which makes someone a tax resident . But  as we both will be going into Spain after July 2nd which is 183 days exactly we won't of been on Spain for more than half of this year so next year when the spanish tax man/woman does our tax they will know this and we won't pay capital gains.. But as we will be doing, best get the advice of a professional. Corral in murcia are amazing and we shall be doing it via them.

If we can help anymore or you have any updates on this please share. We are in the same boat. 👍👍🙂🙂

"aim to get there August too. In spain we will have to submit a tax return next year," You will not be tax resident until 2023, so your first return must be made by end of June 2024 - each year's return is made the year following.

Asked just because my Lawyer was waiting for it to be abolished.

Perhaps someone else knows or heard about it?
