Hi all

We've just bought a park home & take possession on 1 April 2020. We're aware that we have to spend 3 months in Spain before we can apply for residency & we're also aware of 31 Dec. 2020 when all things may change. Our question is this: Does the 3 months have to be continuous or can it be accrued while popping between UK & Spain finalising issues at either end. We'd welcome any input. Carol & Norman

When my wife and I were granted Residencia in 2018, nobody at the police station checked our border entry/exit records (and I don't know how they could have done).

Of course, the airports now have passport e-readers, and the police might (conceivably) have access.

I think the bigger issue is to show intent ...

- a lease/home purchase

- healthcare

- a regular, qualifying income into your Spanish bank account

- NIEs

- evidence that you have paid the relevant Residencia fees at a bank

My view would be that evidence of your intent would carry more weight than having popped back to the UK for a week to sort out details.

Hi Carol,

you dont have to wait 90 days if you know your intention is to make Spain your resident home. You could apply immediately but you would not be allowed to stay out of Spain more than 6months per year during the first 5 years or your residency could be cancelled. Furthermore if you have a property to sell ( or have just sold this year) then you need to not be in Spain this year for over 183days and perhaps apply for residency after July so you avoid being a fiscal resident this year and having to pay CGT on your Uk property sale profit. Remember all stay in Spain this year adds to the 183 days even before you gain residency.
