Hi I’m new to the group thanks for the add. My question is about having the S1. I’ve just read on tips that on the non lucrative visa you need health ins but whilst looking on other sites it says if you have an S1 you’re ok.  We’re actually English but resident in France since 2020. My hubby works online teaching in China/Hong Kong so also wondering if this is classed as working in Spain. We are both retired and reviving U.K. and personal pensions. Sorry so many questions but we’d really like to think about relocating down there TIA 😀

You are English, live in France your husband does online teaching, I do not understand how this can be considered as working in Spain.

No matter which country you live in within the EU you will have to register for tax purposes, which I presume your husband is already registered with the tax authorities in France.

If moving permanently  to Spain you will have obtain residencies and prove source of income and assets this would include all your pensions employment salaries investments and property owned. 

This is the same for anyone from a tird country which UK is now classed as.

Thanks it does sound the same. Yes he’s registered here. That helps us at least move forward I was hoping it would be the same but post brexit you never know. 👍

We've just been through the NLV process, but are too young to have an S1 for some while. As it didn't apply to us, I didn't really research this, but I believe that you still need to purchase suitable private healthcare for the first year, no matter your age or entitlement to an S1 - however, I would seek professional advice. 

Regarding working online, I have seen conflicting advice on this topic.

The NLV rules are quite clear in that it only allows 'passive' income - e.g. rental income from a property. You cannot work in Spain with this type of visa.

Working visas are available for people having a job in Spain for a Spanish company; and 'autonomo' visas for those who are self-employed working in Spain.

These, however, don't cover 'digital nomads' - who could work for a company based in the UK (or any other country), be paid in that country, but actually live in Spain (and, implicitly, carry out the actual work on their laptop in Spain). I have seen advice on other forums stating that as long as the income and tax paid in the country where the company is based is declared in Spain, etc. then this is permissible; however, I don't know anyone that has actually done this - and, as Brits would only need NLVs from January this year and tax returns would not be due until 2022, I assume that no-one has tested this.

I would advise that you seek professional advice and I'd also be grateful if you could update this post (or myself directly) with the advice received.

Thanks RichT, we do it in France and they’re happy for us to be paying social taxes. So was hoping it would be the same but we agree with you we feel we should check it all out. Now to find someone whose good and doesn’t cost the earth 😊😂

Hi again the place I’ve seen this is Place in the Sun. it does seem pretty conclusive with S1 just need to sort the working bit out. So if anyone can recommend someone we’d be grateful 🙏
