Hi - cannot connect to CAD but will persist

However, this is the response I received back today from my solicitors when I explicity asked if I could remain in spain for up to 6 months consecutively but mentioned your 3 month rule:

"I have not heard that you can only be here in Spain for only up to 3 months. I do not know where you have read or heard this but I do not believe it is true. The only thing for residencia is if you are here for more than 183days consecutively or separately over the whole year you should apply for residencia"

As the previous poster made the point with such conflicting evidence it is hard to know right from wrong. As it actually suits me, I am going by the written confirmation from a Spanish solicitor

I would respectfully suggest that your solicitor is wrong: europa.eu says “As an EU national, you are entitled to live in Spain for over 3 months if:

  • you have a salaried position or you are self-employed in Spain
  • or you can support yourself and your family, and you have a public or private health insurance that provides full cover in Spain
  • or you are a registered student at an educational establishment recognised by the Spanish authorities, and you can support yourselft and have a public or private health insurance with full cover in Spain
  • or you are a family member of an EU national that mets one of the previous conditions. The family member can be: 
    • If case of a student: his/her spouse or common-law partner, or his/her children
    • In other cases: his/her spouse or common-lay partnr, his/her children or spouse´s children up to 21 years old or incapable or his/her ancestors.

In all of these cases, you must still register with the Central Register of Foreign Nationals (Registro Central de Extranjeros), no later than 3 months after arriving in Spain.”

As an onlooker to this thread, I wouldn't believe anyone! My last solicitor is Spanish, employing Spanish and English staff and anything they could have got wrong....they got wrong!!

Why don't you wait until after Brexit, if we can all live that long, and see what happens. If you go ahead and make a mistake it can cost you a fortune to get right and it takes forever to go through Spanish courts.

As a member, I google cab.es and get in but officially the site is :-citizensadvice.org.es

As I had said it was citizens advice bureau spain you could have just googled it and it comes up immediately. Peter and I have given you the correct info which we have spent many many hours to research and still you havent acknowledged our help, so if you choose to accept your solicitors view because "it suits you" thats your choice. I know the consequences and prefer to research all government info to maintain legallity. We have helped all we can to ensure you are keeping within Spain,s laws, with added confirmation from CAB and links to other government sites for info so you can now do your own research.

Just taken this from the Europa.eu web-site:

Staying abroad for more than 3 months

As an EU national, you can live in any EU country if you have:

  • comprehensive health insurance cover in your host country
  • sufficient income to live there without needing income support.

Income could come from a pension, if you are a pensioner, or any other source of revenue.

I have not had time to read the complete web-site so accept that I maybe missing something but for this, this is telling me it is possible to stay for longer than the 3 months being suggested

Of course you can stay for more than 3 months BUT YOU HAVE TO REGISTER ON THE THE REGISTRATION OF FOREIGNERS!

It really is not that complicated and has been the law for at least 20 years, just some Brits seem to misunderstand and misinterpret things..."I am not taking residencia as I want to remain British"...." I pay my taxes in the UK so do not need to pay in Spain"...."I just come and go, they will never find out"....

Personally, when we decided to come and live in Spain I read every 'how to' book I could find, went for Spanish lessons in the UK for months, registered when we arrived, have now amended our address from malag to Murci with right to permanent residency, signed on the padron, bought Spanish car, changed to a Spanish licence, am registered with the Spanish health system and pay Spanish taxes.

Others can and will do as they like!

PeterC - so if I understand correctly I can stay in Spain consecutively for more than 3 months so long as I get on this register. currently no intention of living permanently but using the holiday home more frequently in longer stays

How do I get on this register...?

I suggest that as you are not knowledgeable about the wonders of Spanish bureaucracy that you use an asesor or gestor to sort this out for you. In Los Alcázares there is Gloria Quintana, or LS Solicitors amongst others.

Do be aware that if you wish not to become a fiscal resident you are careful to not be in Spain for more than 183 days in any calendar year - in one go or as a total - as this is one of the main benchmarks used to decide who you are taxed by...

Ok - far to much conflicting stories on here so clear to me that no one is really sure and all blame the Spanish bureaucracy

As for CAB - if I could I would...!!
