Habitation certificate

Hi, I am considering selling my house in Los Alcázares but am wondering if I need to supply a habitation certificate, I believe this is a new requirement, I am not due back in Spain until March when I hope to discuss with estate agents but until then would be grateful for any advice or guidance, I have never sold any property in Spain before, many thanks

I've heard that the solicitor you instruct will help arrange for an up to date Habitation certificate to be made available to the new buyers.

We all generally get an H C when we buy a property but they only last so long and we've been told that there is no need to renew until selling and the solicitor/ Abagado will sort this out.

I wouldn't rely on any Estate Agent to give advice as they are only there to (hopefully) help sell the house and they will say whatever they think you want to hear. . It's the independent solicitor who will give good advice. ( not one recommended by an Estate Agent though as that is a conflict of interest )

It's very expensive to sell through Estate Agents in Spain compared to the UK -  Property selling websites or private selling could be worth exploring first, as long as you have a solicitor onboard for the conveyance.

Good morning all

Interesting topic. I have been trying to find out how long a Habitation certificate is valid for. Does it actually have an expiry date, and does it have to be renewed at the point sale? I have been told you can't actually sell a property without one. I have asked my 'useless' firm of Solicitors and they didn't even reply! Any reliable info will be gratefully received, and I'm sure will be of help to many on here.

i guess my biggest concern is the house I am looking at as a possible purchase does not have a HC, was built approx. 15 years ago and has never had a HC, though they do pay the rates etc. .Don`t want to get dragged into any legal conflict so a little wary, I know the lawyers are supposed to sort these things so will have to hope I pick a good one, if anyone has any recommendations I would be most grateful.
