Tourist license

Hi we are looking at buying an investment property but have been told that we now need to apply for a tourist licence. Also that this licence can take up to 10 months to come through. What experience of this have people had and how long is it generally taking to come through ?

ours took nearly a year to completion but you can start to rent out once you have applied...I think its taking less time now as they had a huge backlog..we had someone ubmit our application for us as its in spanish and complicated but we did the rest ourselves. Took 7  months for the  inspection visit!

thanks so much for the info.  When you say that you can rent the property when you have applied, do you not need the license number to be able to advertise your property?

yes but sometimes they give you a number when your application is received....you can rent yourself without advertising....some sites used to let you advertise and say licence pending...not sure if they still do that.

We only let friends and family us our apartment until the licence number came through but the guardia registration took another two months....might be a bit better now

Good morning...

Yes it is now compulsory to have rental property inspected and assessed and to display on the property and in all communication the registered licence number. The is a rapidly growing band of inspectors and if caught without a licence recent fines in local courts have exceeded €100,000.00 as it is now legally seen as tax evasion in Spain. The document to apply arevin Spanish so best to get your lawyer to apply usually between €75-€150 charge. We waited 8 months for our inspection and were failed on two minor points ,,,it is a strict inspection of everything!, We have corrected and added what the inspector wanted and have now waited nearly a further four months for re-inspection. Do not believe those who go ahead and rent and hope not to get caught. The penalties in court have bankrupted some owners.

Yes it is true if you only rent to family only you may not require a licence but the inspectors are now asking we hear in our area for documented proof that these people are family so its getting tougher!!

We heard that as well that as soon as you have registered for your licence you can legally rent.

The advise we received from our lawyer with close connections to the tourist board was not to rent the property out. 

The reason being one complaint about it and any ides of receiving a licence was gone and you may also 

get charged in court for renting the property out.

This whole area of are you OK to rent out once you have submitted your licence application is very woolie and 

unclear as there was nothing in writing to confirm this.....being safe was better than being very sorry!!
