Hi we bought our house in ricote before Dec 31st and have our padrons is it OK for us to go back to ricote on May 15th we have been told we can and to keep our padrons with us as proof please help

Are you coming from the UK? If so not allowed to travel for holidays as it stands at the moment

Permitted reasons from the British government to leave the UK, does not constitute permission to enter Spain.

Hope you've got the message .....only residents or in process of residencia application ....33 people sent straight back to UK from Alicante airport yesterday!

Having a Padron is not the same as having residencia. If you are in process of obtaining residencia and have been approved, then the proof of approval may get you into Spain(but many have been refused entry at the moment). However if your intention is to stay non resident then you should not be on the padron. Only residents should be on the padron as it is a system of census to allow the Town Halls to get extra funding from the Government. It also sends a message to the Tax authorities you are a tax resident. It is actually illegal to be on the padron as non resident

 Padron is only for residents and although you may be asked for the up  to date certificate when you buy a car this is as proof of address and it is not a legal requirement.

There could be tax implications in the future as padron is a way of proving how long you have lived here....ie as a resident!!

This is from CAB Spain...

holiday home owners should not register. The padrón  is only for habitual residents of Spain. Registering could have tax implications as the person inscribed is stating that they habitually reside in Spain.

However, it is not a good idea for non-residents to register.

This is because the padrón accredits your residency in Spain. If you are not resident in Spain, then any future attempt to become resident may be complicated by the fact that your name appears on a padrón municipal.

Case study: Belgium residents Bertrand and Anne Koen have a holiday home in a small town in Spain. Being EU citizens, they were able to register on their town padrón using only their passport (as the local mayor has not enforced any rule requiring an NIE to register).

After several years of being on the padrón, the Koens took full time retirement and moved to their holiday home. They transfered their fiscal residency to their Spanish home and applied for a residency permit from the Immigration Office.

As part of this process, they attempted to import their car. As recently arrived residents of Spain they were eligable for a tax exemption on the import duties on this vehicle.

But when the Tax Authority ran a check against the Koens, their names appeared on a padrón list. Since the padrón residency proved the Koens had been living in Spain for several years, the Tax Office cited this as proof that they are not eligible for the recently arrived tax exemption and charged them full import duties on their vehicle.

Who is obliged to register on the padrón?

Only Spanish residents are obliged to be on the padrón. If you are a Spanish resident you must apply to be on the padrón of the municipality in which you spend the most time during the course of a year.

There is no obligation for non-residents to register on the padrón or with their local authority.

You are wrong. Padron is for residents only, and you don't need to be on padron to buy a car or house.. So many people have been fed lies by estate agents or ill informed people in order to get extra money from Madrid as the Town Halls resources are governed by the amount of people on padron. 

Research it, I, m not wrong. Not all Town Halls are devious, some refuse non residents but lots do to get the extra income.

I just wish the Spanish Government would get it right for once! What was all that fanfare about lifting the ban for UK to come from the 30th March???? what has happened to that or is El Presidente Puig a liar?
