Estate Agents ???

Does anyone know if you have a second Estate Agent company listing your property and they sell it. Do you just pay their commission fee or do you have to pay anything to the first Estate Agent you registered with as well ???

Thanks in advance for any advice.

Many people have their property here in Spain listed with more than one agent - sensible.  But I am sure you only have to pay the agent that actually secures a sale for you.  Also a good idea to get the selling agent or yourself to contact the original agent once you have a sale so they can remove it from their records.

With the First agent as long as you did not make the mistake and sign an exclusive agreement - then you only pay the agent that sells it. On this basis you can have any number of agents.

If you sign an exclusive deal then under contract you only deal with that agent.

If another agent sells it whilst you are under exclusive contract it is not your problem. The agents usually agree to split the fee but that decision in not yours.

A word of warning. I signed an exclusive agreement to get the perk " the agent will pay my legal fees"

They gave my keys to another agent without my knowledge or permission who subsequently sold it.

The first agent refused to honour my contract and would not pay my 600€ legal fees as per the exclusive contract.

I have to decide now whether to take them to court or not. 

Do not sign an exclusive sale agreement! 

Mine was a well known agent , sorry Con- man.

Always best to discuss with them and then get the agreement in writing. No surprises then when it's sold. If an agent gives your keys to a third party, agent or not, without your consent, they are breaking the law. Unfortunately unraveling the law in Spain when something goes wrong is not easy.

Spain is full of people who promise the world but deliver nothing Or don’t reply to e mails etc etc etc.  As you probably well know. That’s why I’m getting out. It’s all a facade and fake !!!!

But thank you for your advice though. It’s appreciated.

Dear RMA, 

I had a signed Exclusivity Agreement.

The " Idiot " claimed as he did not sell the house, therefore there was no agreement enforceable.

I had no idea who sold my house, he made out his agency did. They only ever had one set of keys! I only found out who it was when their recommended conveyencer distributed ' my money'.

I used their recommended Legal Agent because I was not intending to pay under the Exclusive Agreement.

When challenged the Conveyencer she did not want to help. Says it all - another CON.

We all know Agents in Spain need no licence, no approval, no training and unlike the UK they have no supervising agency.

I think it is right and proper that new ex-pats hoping to relocate here in Spain,  realize all this and understand they may be dealing with a well known shark.
