House deeds.

Hi, we have just taken control of all of our own bill payments and taxes ending our professional relationship with our solicitor. The solicitor has asked us to collect all of our paperwork from their office, which I am happy to do. I know that we need to visit a notary to cancel the PoA the solicitor had.

My query is, is it typical practice here in Spain that the homeowner holds their own house deeds?

Hi Anni

I was in a similar position and thought the same.

The response was 'why would you allow someone else to hold the deeds to your home', therefore i assume it is the 'norm' in Spain.

We've always kept our own escrituras for the purchases and sales of the various properties that we have had over the years but some solicitors like to keep their clients' under their control by suggesting that they look after the property deeds on their behalf. There's no reason on earth why you would need to do this and as long as you keep all your documents in a secure place, they're as safe with you as they are with a random solicitor who may just keep them in a cupboard in his office. I'd keep a couple of photocopies of the deeds in case you need to prove that you own the property or get a couple of "copias simples" from the Notary where you signed for the property. Remember that the oficina del registro de la propiedad keep a master copy of all escrituras on file.

Thanks Mags for your informative reply, in addition to making a few copies I will keep this information with my deeds, just in case it is someone other than me dealing with the sale….
