Only residents should sign on the padron. Some councils have encouraged all householders to register, so they can claim the maximum payment from central government but this is not legal and they could have problems if they are audited.

lAs far as I am aware if you are a resident you obviously have to sign onto the Padron,

However it is purely voluntary if you own a property and pay your non residence tax to apply for this.

I have aske Peter before on this subject to please enlighten me and show me where it says it is illegal?

Hi

Could you please clarify where you obtained this information from? It is entirely different from my knowledge of being a Spanish resident for over 20 yrs

Thanks Ed

Hiya. We bought as noñ residents about 18 months ago and I researched it with the local council and double checked with my solicitor before completion and again after.  As was said in an earlier comment, some councils 'encourage' this to get money based on the number of people on their padron register, but it's not a legal requirement.  We purchased our car without being on the padron and it was never mentioned or asked for.  I'm not disputing anything, it's just my experience from researching, checking legalities and purchasing a car :)  Update - its on the CAB website also to confirm non residents shouldn't register on the padron.

Ok fair enough as I said it is a legal requirement if you are resident

I believe Peter means it's not legal for the Ayuntamiento to register holiday homes as they are doing it for the wrong reasons. It's not illegal for you to do it but it's not necessary if you are not a resident. We were advised by our legal eagles nit to register for one. They know you are there from your property tax anyway.

It's only necessary if you are a resident. The poster said he is only using his property for holidays.  You don't do it unless you are a resident.
