We have recently done that using a UK solicitor to do the POA costing £250 got it done within the week and sent it to the Spanish Solicitor all sailed through without a hitch

Thanks, as long as we can recind perhaps it might be a good temporary arrangement.  anne.

You can always revoke the power once the work has been completed. In any case, even with power of attorney, a solicitor should always advise you of what they intend to do, as you are authorising them to act on your behalf. This means doing what you request and not necessarily what they would suggest, within the law of course. I understand Peter C's comment about not using lawyers suggested by an agent, but bear in mind also that agents will usually be aware of which lawyers are likely to give you the best service, having worked for many years in the area. Even if there were to be a conflict, the agent will have its own lawyer, which is not usually the same one as they would recommend for the conveyancing for their clients. As a caution though, I would ask your agent if they are getting any financial or other benefit from recommending a particular service. For example, we prefer to work without that kind of agreement so that any recommendation we give is genuinely unbiased and without any financial benefit to us.

Another thing to bear in mind is that if an agent regularly works with a particular lawyer, they may well have a good relationship with the staff there and that will help the process to go much more smoothly for you.

I hope this helps, Anne!

I would never use a solicitor recommended by the estate agent. What happens if there is any dispute between you and the agent? You should get an independent abogado IMHO.

I understand your concern Peter, but generally an agent will have their own lawyer not involved in conveyancing, so if there were to be a dispute, you should have no conflict of interests. I would say though that you should ask if the agent is getting any benefit from the recommendation, as this could affect their objectivity. We don't receive benefits for any of the recommendations we might make, for example, and I know that if I suggest a particular tradesperson or professional, it is because I believe it is the best option for my client. In the end, my clients' interests are paramount and should always be above and beyond the agent's. I hope this helps!

I feel that too. Our lawyers were Sun lawyers who we saw many times at Place in the Sun exhibitions. The agent we bought through could not have been more helpful and she has become a friend helping us with other things. Only took a couple of hours to get legal stuff done. Lawyers,Notary and Bank all in the same block. Good luck.

Hi D.  Well that sounds scarey to us newbies.  We have appointment on Monday to go to sign the Power of Attorney.   It's with a local Los Alc Aborgado.    What bad advice did you get.  If we know that we can be one step ahead.  Thanks, Annie.

Hello Gillian, we're in Los Alcazares so we are using a local solicitor.  But thanks.

Now why didn't we know that before hand!  Our psychic powers must be at a very low ebb due to a month of house packing and hardly any sleep.   Tip:  never catch a flight where you have to be at the airport at 3:30am.
