Anyone heard of the above Regulation that has come into effect since Brexit. Apparently this authority has to be applied for by the house holder in Spain that family or friends are  visiting.   As visitor  is staying in private accommodation, the house holder has to visit Police Station in locality and apply for this visitor/family member to stay in house.  €75 for the pleasure of this with € 6 more on collection of completed document. This completed original authority has to be produced by visitor when arriving in Spain. I found this on infoimmigrationspain.es web site.

The law requiring a 'letter of invitation' has been in effect since 2007, as it applies to all non-EU visitors to Spain - so it has become effective for visitors from the UK since Brexit.

There are several scare-mongering articles in the British media (one in the Daily Express today) and on the websites of immigration lawyers. Some also state that you must be able to prove that you have a minimum of €100 per day to live on for the period that you are here; and also that you have medical insurance (although that would be covered by your EHIC / GHIC card).

The Gov.uk website states: 

If you enter the Schengen area as a tourist, you may need to provide additional documents at the border. As well as a valid return or onward ticket, when travelling to Spain you could be asked to show:

  • you have enough money for your stay
  • proof of accommodation for your stay, for example:
  1. a hotel booking confirmation
  2. proof of address if visiting your own property (such as second home)
  3. an invitation or proof of address if staying with a third party, friends or family. A carta de invitation completed by your hosts is one of the options available.
The phrase that I have shown in bold is interesting, as this occurs in many articles, but it doesn't say what the other options are. In May 2021, Citizens Advice Bureaux Spain, who are generally very good at understanding and informing on the law in Spain, stated that they had checked with Spanish Immigration officials and received a variety of responses, indicating that the issue was either not understood, or, more likely, not important to them.
Personally, I have had many visitors since Brexit, none of whom have been provided with a letter of invitation by me and none of whom have ever been asked for one. In a quick google search, I also can't find any articles about anyone who has either been asked for such a letter or been denied entry for not having one.So, in short - Yes, there is a regulation, but no one ever seems to apply it...Hope this helps!

Glad we have just completed the sale of our property didnt purchase property for ourselves and family to use,  then having to apply for family to come to use apartment and pay for a document.It was becoming a money pit when visiting.I had a Cyclist going into back of my car Cyclist rang police I got fined police tried to say my licence not valid to drive in spain which it was and to check with British Consulate,I since found out others had same thing happened to them apparently Cyclist trying to claim for new bikes. Catalytic Convertor got stolen from airport parking took a year to get funds from Companies insurance it had to go through courts.Then in October we were passengers in relatives car 4 police pulling cars over at roundabout trying to say husband didnt have seat belt on which 100% did, police think it's all right to gave €200 fine then another €6 when you pay.Its like the Spanish trying there best to put us off going.

Just to be on the safe side I always send my visitors a personal invitation letter showing the address they are staying at. 

I also tell them not to volunteer this letter, and to only show it if asked. None of them have been asked

Don't believe it is necessary to pay for the official one
