We are about to  buy on sector d with  no certificate .Solicitors and estate agent  say they can sell a property with out this .

My question is how can you sell a property with deeds when it has  no habitation certificate so not a legal build .

Can anybody please help me .

I have spoken to several  solicitors in the UK which are Spanish lawyers regarding this and they say don't buy.

What are the residents thoughts on this matter as I've fallen in love with a villa.

Help!!

Yes the other thread has created another debate on this long running subject, but in my opinion, you have made the mistake of 'falling in love' with a property, best to remain objective. Don't believe any agents, they will only be thinking of their commission, and if the paperwork is not in place, walk away! There are thousands of properties in Spain that have all legal paperwork in place and no onward worries! Whatever you do, don't put a deposit on a house if you're unsure of ANYTHING!

Always remember you have to sell that house at some time in the future. If necessary consult another solicitor.....don't listen to the 'part time' lawyer in the bar, Forum or wherever. Good luck.

You can buy without "cédula de habitabilidad" but you may have to deal with associated problems contracting water, electricity, gas, mortgage... and you have to sign in the Escritura that you are aware there isn't any, so all the responsability from then will be yours.

Make sure why the property doesn't have the "cédula de habitabilidad", if everything is ok they would not have a problem to request an architect for a technical report.
