We sold our house in the UK our main residence if we now move to Spain in the same tax year do we pay capital gains tax despite selling before we move ? If we wait until next year does this mean that we don't have to pay any capital gains tax ?

its the yin which you become fiscal residents that counts….make sure its the year after you sell your house.

Are you resident now or planning to obtain residency this year? If you,re not yet resident but sold house, delay going to Spain until after July, ie. less than 183 days left in this year so you won't become a tax resident until next year. If you have made good profit it's worth renting in Uk until you pass 183 days if you have no relatives to stay with. If you do move to Spain in next few months the whole year you are deemed a fiscal resident since Jan 1st and will pay CGT on your UK profits.
