Hi we have a holiday home in Lo pagan can we set up a Spanish will in the Uk for it for myself and wife or do we need to be in Spain

Hi.  You need to get a Spanish Will drawn up in Spain for all your Spanish assets that adheres to English Law (this is stipulated in the Will). It's a common thing to do and means that, on death, English rules are applied.  Hope this helps.

Spanish Wills are signed at the Notary and then registered in the "Registro General de Actos de Última Voluntad". Citizens of countries other than Spain can prepare their Wills under the laws of the country of which they hold a passport. As Britain is a collection of several countries, your Will should be done under the laws of "England and Wales", "Scotland" or "Northern Ireland", whichever applies to you and never under the laws of Great Britain, which don't exist. You can get your Will done through an Abogado or if your local Notary has English-speaking staff, you can save money and get them to prepare your Will directly there. Or you could just take a translator to the Notary with you. If after a time, you wish to change the contents of your Will, then this must be done in the same way as previously and the registry replace the previous Will with the updated one. The Will that is stored in the registry will be the one that will be valid at the time of death.
