We reserved a property in paraje valle de sol with a 5,000 euro reserve fee. We paid this 5 weeks ago. We went through an estate agent and they appointed a lawyer. The property was a rent to buy and we are being told that the two owners of the property are trying to come to an agreement about how best to sell it to us. We are cash buyers. We are British so non eu. We are now being told that we need military permission to buy. Is this normal procedure with buying a property, our lawyer does not give us much information and does anyone know if military permission is needed for purchasing Villa in paraje valle de sol. We are going round in circles and I’m getting to the point where I think this might all be a con. Thanks to anyone who can supply me 100% factual information. K

You have previously asked about military permission and been given advice by myself and another experienced contributor. Have you taken any of the actions suggested?

The other issue that I would caution you about is using a solicitor arranged by the estate agent. You should always get an independent solicitor, preferably one that is recommended to you. 

Why don't you find an independent solicitor and ask them to review where you are with this and they could potentially replace the solicitor that you are currently using, if you are not happy with them..?

Hi Rich, I’ve emailed Spanish land registry. No response. I spoken to another estate agent in Murcia, she says not needed. I’ve sent my estate the map of where permission is needed. I be researched god knows how many sites. Most of them say not needed, but there are a few who say yes. Hence my frustration at desperately trying to sort this out. I have again emailed the estate agent and she has come today, saying ‘ trust the solicitor’ but I don’t.  I’m not being lazy when I write on this site, but have tried to be proactive and am going round in circles. I think that your suggestion of hiring another solicitor to check the details is the best way forward. I was holding off doing this, as the company we are using at the moment has Poa and is applying for our nie and bank and utilities.

Remember this is not the only property in Spain - not being keen on banging my head against a wall I would try to get out of the deal.

If I back out, do I lose 5,000 reservation fee? We’ve waited 5 weeks for any paperwork?  I’m almost at that stage. Didn’t expect it to be a walk in the park, but this is way out of any of my control!

We bought in Los molinos last July on the other side to valle de sol..our solicitor who we have used for 3 purchases and one sale advised us this was something she needed to explore as part if due diligence ..she did that..it wasn't necessary and the purchase went ahead

Bit late to the party on this and not sure how you are getting on?  We bought in Valle del Sol in July last year and we DID have to have a military permit but this was only something that came to light just as we were due to complete in April (so delayed us 3 months)

Since Brexit, UK and now non-EU, military permit rules apply (it was never abolished for non-EU citizens as far as I know) but this only applies for specific scenarios...  Our solicitor had never had this before us so never enquired about it so therefore only came to light when sending everything over to the Land Registry the day before.

I think we paid around 1250€ to our solicitor plus another £700 in the UK for all the paperwork so its not cheap and annoying because another property may not need it
