My understanding is that when a builder completes a property they apply to the Town Hall for a habitation certificate and are issued with a Licencia de Primera Occupacion. (which is what paul69 has been provided with).
When the builder sells the buyer is then issued with a Licencia de Segunda Occupacion with their details on it (which is what paul69 has been promised).
Both are different types of Cedula de Habitabilidad or habitation certificates.
It looks to me like paul69 has got this covered so hats off to him and his lawyer!
I also understand that where people get into difficulties is that they should apply for permission to do alterations to their properties and those permisions are then recorded on the Cedula de Habitabilidad. I gather that lots of work in Spain is done without permission and so without any amendment to the habitation certificate.
Thanks mr B it is to be written into the contract that all certs are in place, the selling bank have agreed everything as no bank would enter into a legal contract they cant deliver on, as i would sue and win, i started all this to stop the scaremongers (who dont have correct certs) from putting people off buying. The monsoras were built legally unlike the masa ones, a call to any spanish lawyer will confirm this. So please folks no more scare stories and when i complete i will upload my certs with pride😂
Paul, as well as proving your point it would be really helpful if you did post a copy of your Second Certificate so others knew what to look out for when buying or what they are missing if they have already bought.
Interesting HK, It sounds that unlike a UK house purchase, it takes quite a long time for the deeds to materialise after contracts exchanged??

Maybe it's quicker in the UK but our Solicitors have got it in hand and there has been a lot of Monorsa Villas sold recently so we are not worried about the deeds.
