“Civil Service pensions are exempt from tax,under income in Spain.”

Inaccurately expressed. They must be declared, but in a box for ‘exempt income’.

There is a change to your tax bill but nothing like as much as if the pension was declared along with other income. Be careful, as we were advised wrongly about this - ALL income, worldwide, must be declared, but in the correct way. The law was different before 2016 and many/most gestors have not bothered to keep up with the rules - after all expats are a small part of their business, rules for native Spaniards are different, and if the taxman does fine you it will never be their fault, solely yours. I am content to pay for mistakes I may make but refuse to pay someone to make mistakes that cost me money.

The Spanish tax year runs from 1st January to 31st December. Once you have spent 183 days in Spain you are liable to pay tax for that whole tax year, not just the part from when you had been there that long.

Either a serious misunderstanding or sadly and more likely an incompetent solicitor. Check with the Agencia Tributaria, but be aware that each funcinario may give you a different answer...

I understand completely what you're saying.

My situation is that I may decide - next year - not to spend more than 182 days in Spain and therefore, under the current 'deal', would be a non-fiscal resident. If we did decide to stay more in Spain than in UK, then I would have to let my solicitor in Spain and accountant in UK know. I understand that in that case I would be fiscally liable in Spain from the beginning of the year (Jan 20) and fiscally liable to UK up to the 31st December. However, if I did sell a property in UK prior to the 31st December then any CGT would be due in UK. Thanks for your info.

For anyone looking to book an appointment for the 'padron' who doesn't have fluency in Spanish, I'd recommend a visit to Costa Calida Properties office on Sector A and ask Denise (brilliant) if she would ring and make the appointment for you. We were advised to do this by Dawn ( brilliant) at our solicitors (PALS in Pte Mazarron). Denise' colleague (brilliant) made the call while we sat with her in the office and only charged us 5 euro for the call - it took all the hassle away. Brilliant

Agreed.

But all has to be declared under the 720 declaration, which is still being looked at by the EU courts as being illegal, on the grounds that the Spanish in the UK do not have to declare the same as we do in Spain.

At the end of this year, all expats by law in Spain have to declare every bank account, savings account etc world wide.

Heavy finds will be imposed for not doing so.

Again information we have been given by our accountant.

Brexit, who knows, Spain will not lose money, and ex pats are seen as rich pickings.

Just make sure you have the correct paper work when going for the padron and ensure you ask for the correct one at the desk
