How do you know this? Spain never checked before how long anyone from EU countries stayed, that only started after Brexit and UK became a third country.
I'm still unsure how closely they monitor EU citizens since Brexit but strongly suspect they won't kill too many golden geese from other EU countries since they obviously would lose a fortune in taxes if everyone started selling up or stopped buying property here. I think they just target UK citizens.
However, as to the application Spain may have made to the EU to allow flexibility as a special case, I doubt the EU could agree to waive the 90 day rule as it would open the floodgates for other EU countries, and, in any case, they have the bilateral option so why bother applying in the first place with that as a fall back?
OR, they could just do what they always did before and ignore the Schengen rules altogether. I reckon they will take the line of least resistance & take a relaxed attitude in favour of holding onto property and non res. taxes not to mention all the revenue longer term tourists stay in the country spend. Just my opinion.
