Police fine

Has anyone had the unfortunate experience from the Spanish police been given a fine for no genuine reason.

Today myself & husband were passengers in my sister-in-law car on approaching the round about in Alcarcares just beside the arches there were police pulling cars over they asked my sister in law to pull over. We did so and one of the arrogant police officers were stating my husband who was a rear passenger did not have his seat belt on which 100% did.We tried to reason with them and say this was not the case but they still issued us with €200 fine.One officer said if we proved our NIE we wouldnt get fine but then back tracked and said after I provided NIE fine still but dont have to pay today.To me these are corrupt  officers has anyone had a similar experience and if so how do you appeal.

If it was the local police then you complain at the Town Hall. You need to take someone who speaks good Spanish. The town hall will pass the complaint onto the police commissioner who will look into it. 

Bear in mind most fines are reduced to 50% if paid within 20 days so you need to check the paperwork and see what it says. 

Police are not allowed to issue on the spot fines to be paid immediately  or ask for cash, if they try this then say you will go to the police station with them to pay it there. This used to be quite a common scam amongst some police officers, taking cash fines off tourists for no good reason.

Your sister in law could contact her car insurance and see if their legal dept can help, depending who the insurer is she may be covered for dealing with traffic fines and at the very least they could offer advice. It's worth a phone call I think.

Contact the Citizens Advice Bureau Spain's website and Facebook group. They have lawyers on hand who can assist in this type of problem.

I have contacted the Citizens Advice Bureau three times and they have never responded to me, so my advice is don't bother. You should have taken the police officers details and reported him to the council office and the police station.

Hi thanks for your reply I am due to fly home Saturday its Babk holiday today I may try the town hall in Sucina tomorrow.I am Seething come to our holiday apartment couple times a year and get €200 fine for nothing due to corrupt police.That with Brexit seriously made my mind up to sell up I'l spend my money else where other than Spain.

Hi thanks for your reply I bet if my Sister-in-law car hadnt just past its test they would have tried there best to fine her because one of the corrupt officers was trying his best to pick fault with her car.And given arrogant threats if we dont pay fine they'l seize her vehicle.Well that's definitely made our decision to Sell up we could go out today be stopped and police just issue fines for sake of it.

The police officers details should be on the fine, also details of how to appeal if you dissagree with the fine

Obviously you speak perfect Spanish as you say the officer was making arrogant threats, and saying they are corrupt, in my 25 years plus years in Spain I have never had a problem with the police always found them courteous and helpful.

You have been lucky - sadly over the years there have been many reports of similar happenings.
