If the EU were to change 90 day rule for one country it would have to apply to all 3rd countries. Not likely to happen. Unfortunately we've lost control of many things which we benefited from during EU membership. Even if the mantra "Spain needs us" we're true, they can't do anything about it as ...

...overall they EU agreement would be required. That ship has sailed.

We could think about rejoining in a few years, and solve all this hassle.

Sean is absolutely right, all the talk about parity ignores the obvious, Spain as a member of the EU cannot make the change, even if it wanted to, without the agreement of all the other Schengen countries,.

All that the Spanish authorities can do is shut their eyes and they have been known to do that before in other matters..

However, who wants to test that out?, in the days of computerised recording of travel movements, ( from scanned and stamped passports for 3rd country travellers)

Remember one of the overstay penalties that can be applied is banning of future entry.

If you decide to risk it, giving the Guardia any grief would not be recommended, in case they decide to look at every page of your passport.

Hi your absolutely right but how does Cyprus get away with it there must have been an agreement with them somehow. Maybe that could be an example. 90 days in 180 is ok really if you have a holiday home.

Cyprus is not yet a Schengen country, yet so does not have to comply.  However it is obliged under its EU membership legal agreements to move to compliance and its under ever increasing pressure to standardise to the Schengen countries laws.

Oh well let’s hope the Spanish welcome us back. Some of us never wanted to leave the EU. Having said that I’m still loving my holiday home here in winter. just pray for better times for the people of this beautiful country

Yes, I do permanently Iive in Spain and have done for almost 38 years and have also bought and sold various properties during that time. The 90 day rule has always been applicable for non-residents of Spain but as the UK was a member of the EU it was never really enforced (hence so many Brits liv...

...ing under the radar) but with the Schengen ETIAS rules coming into force this year, there will be a lot more control of those who enter and leave EU countries. As the UK is now a third country (not a third world country!) passport checks and possible entry and exit stamps will be the norm and anyone overstaying could incur a fine and even a ban on re-entering the country for 5 years. There are thousands of Spanish property owners from non-EU countries who have been living with the 90 day rule quite successfully and their properties have not dropped in value because they can only personally use them for 90 days at a time! The world will not come to an end because British property owners can now only spend 90 days in every 180 in their properties. The newest property markets now include Belgians, Scandinavians, Russians and other European citizens, who are still keen to buy properties in Spain. I will not be in any queue for the Oxford-Astra-Zeneca (the Swedish-British pharmaceutical company) vaccine, as Spain is vaccinating with the Pfizer vaccine and my health-care comes from Spain, not from the UK.

Be interesting to know if you still have a British passport, having lived in Spain for so long ????

You can be a foreign resident as I am in France holding British passport . Before brexit many on Camposol broke the rules if you stayed longer than 180 days you should apply for residency and pay your taxes on Spain.

Of course I still hold a British passport - I may have permanent residency in Spain but I'm still a British citizen! It's illegal for a citizen of another country to reside in the Spain without a valid passport from their country of citizenship.

I don't know who you are but presumably you live in Spain and are British and own a property well if this 90 day rule is not rescinded your property value will drop big time, bars, restaurants and shops in your area will close because the Costa Calida Coast relies on tourists and holiday home own...

...ers from the U.K  you only have to look at Corvera Airport as an example. I most certainly did not vote to leave the EU so don't ever accuse me of that and I'm sure you'll be joining the que for the Oxford University Covid Vaccine that was pioneered in what you are now calling a third world country.

Phil Smith.

Nobody is calling the UK a 'third world country' - the UK is a 'third country' in relation to the EU - as for example are Canada - Australia - Israel - in fact according to the BBC website:-

'A "third country" basically refers to any country outside the EU, and in this case outside its economic structures - the single market and the customs union.

Businesses in a third country have to fill in customs declarations, for example, when they import from and export to the EU - whether there is a trade agreement or not.'
