Have you asked the solicitor that dealt with your property purchase ?

Sometimes they hold the original deeds in their safe keeping for you.

If l had a mortgage which is finished would the bank hold the deeds . The solicitors office went  bust 10 years ago.

Spanish properties do not have deeds in the way that British properties do. There is no document which 'belongs' to the property and is passed on to each new buyer.

You should have an escritura, made out when you bought the property. That is the legal document which confirms your ownership.

We bought our house with a mortgage. We had our escritura plus another 'fatter' version which included the mortgage details. After we paid the mortgage off, the bank gave us another document. This needs to be taken to the Notary, then to the local land registry office, this then removes the debt of the mortgage from the title of the property. One day we will get round to doing this! Essential if we ever want to sell.

I think Jason has answered your question. We haven't got round to it yet although our mortgage was paid off years ago. It probably would have been cheaper back then!

Did you have a mortgage with the bank? also if you finished paying your mortgage off did the bank  return the original deeds back to you. Thank you for any help.
