Hi All,

I have a question and hope someone can point me in right direction. I purchased an off plan property in November 2022. It was a 3 bed, 2 bath property. Paid Mercers 3000 euros reservation fee followed by a further 19,625 euros to developer at each stage of the build.

Long story short, I went to visit the site May 2023 and the developer had changed the layout to 2 bed, 2 bath without telling me. There are 6 apartments and they had told the other 5 but not me. Developer agreed it was entirely their fault (Bros Management) and contract was drawn up for return of all funds by July 2023. Despite this, I have been paid in dribs and drabs, and I am still waiting on 2,625 being returned. Lawyer is worse than useless, Mercers (the estate agent) just tell me they are chasing it up and I feel I am being completely ignored by everyone now.

I managed to get the email address for developer but these emails are being ignored too. I am prepared to fly over and see if I can get him face to face but fear this may be a waste of money and time.

Any help as to what to do next gratefully received. Thank you!

Hi there,

The question is what resolution you want. Your money back, I imagine. 

I would consult a better, more reputable lawyer. And Mercers are well-known to be rather shoddy fwiw. But the problem is that with a relatively small sum like this you might not end up quids in. Even if it's sorted after fees.

I'd also take advice on breach of contract on turning it into a two-bed rather than a three. But again, the game may well not be worth the candle. It all depends on what legal agreements you have in place.

Some friends of ours call Mercers, "Merciless" - needless to say, they are not the most reputable.
